Freedom of information

NHS County Durham and Darlington has a legal duty to provide a Publication Scheme under section 19 of the Freedom of Information Act 2000.  All public authorities, which include NHS organisations, need to have a Scheme in place which contains links to published information available electronically or details of where publicly available information can be obtained.  A copy of the Scheme is available below and is currently under development.

The Freedom of Information Act allows access to non-personal information.  The Act states that requests must be in writing, which includes email, and include a full contact name and address for correspondence; we cannot therefore accept requests by telephone.

Can I use the Freedom of Information Act 2000 to access my health records?

No.  The Freedom of Information Act 2000 only relates to non-personal information.  If you need to access health records held by NHS County Durham and Darlington you need to do this using the Data Protection Act 1998 or, in the case of accessing information on the deceased, the Access to Health Records Act 1990.  Please send your request to the address above.  If you want access to your GP health record you need to approach your GP practice direct.  NHS County Durham and Darlington and GP practices are entitled to levy a charge for providing access to personal health records.
